Am I eligible for a divorce?

In order to get a divorce in Singapore you will need to satisfy 3 requirements:

  1. You must have been married for a minimum of 3 years unless the filing party can prove they have suffered exceptional hardship or their spouse has been exceptionally unreasonable and cruel.
  2. Either party must be a Singapore Citizen or Permanent Resident, and have been living in Singapore at the beginning of the divorce process or have lived in Singapore for the 3 years immediately preceding the divorce application.
  3. The party filing for divorce must show that there has been an irretrievable breakdown in the marriage.

What are the grounds for divorce?

The party filing for divorce must show an irretrievable breakdown of the marriage. They must prove this against one of the following areas:

  1. Adultery;
  2. Unreasonable behaviour;
  3. Desertion for 2 years;
  4. Separation for 3 years (and the defendant consents to a divorce);
  5. Separation for 4 years.

What is a uncontested divorce?

Sometimes referred to as an amicable divorce, the uncontested divorce occurs where both parties can agree to all of the ancillary issues.

This includes:

  1. the reason for divorce;
  2. the party who will obtain care and control of the children;
  3. how the assets are divided;
  4. a reasonable amount of maintenance.

Under an uncontested divorce, the interim judgment will be issued after 4 weeks, before final judgment is given 3 months from the date of obtaining the interim judgment.

What happens if my spouse refuses?

It is still possible to divorce, but it would be through a contested divorce. This can be significantly more expensive than an uncontested divorce and typically takes between 6 to 12 months to conclude on average.

How long does a divorce take?

It depends on the complexity of your situation and the amount of negotiation involved. On average, an uncontested divorce can take 4 weeks to achieve an interim judgment. A contested divorce may take 6 to 12 months to conclude.
