The Court’s Approach in Singapore
In Singapore, the division of matrimonial assets is governed by Section 112 of the Women’s Charter. The courts apply a structured, three-step framework established by the Court of Appeal:
- Direct Contributions – Calculating each spouse’s financial contributions, such as payments for the matrimonial home, CPF withdrawals, or loan repayments.
- Indirect Contributions – Considering both financial and non-financial efforts, including raising children, maintaining the home, and supporting a spouse’s career.
- Averaging and Adjustments – Balancing the two ratios, with flexibility for the court to give more weight to either side, to reach an outcome that is “just and equitable.”
This structured approach ensures that both financial input and non-financial efforts, such as caregiving and homemaking, are given due recognition.
What Counts as Matrimonial Assets?
Matrimonial assets are broadly defined under the Women’s Charter. These typically include:
- Property acquired during the marriage, such as HDB flats and private residences.
- CPF savings accumulated during the marriage.
- Cars, jewellery, investments, and other financial assets.
- Assets acquired before the marriage if they were substantially improved or used by the family as a home or for family purposes.
Exclusions: Gifts and inheritances are usually excluded unless they were significantly improved during the marriage or used as a matrimonial home.
